1. Scope

These Terms of Use govern the use of the Photo Locations app (hereinafter "App") and the associated website photo-locations.info (hereinafter "Website"), operated by:

2. Service Description

Photo Locations is an app for photographers to discover, save, and share photo locations. The app offers:

• Discover photo locations from the community
• Save your own locations (private or public)
• Organize in collections
• Share collections with clients via web link
• Navigate to locations

The app is available in a free version (Community) and a paid version (Creator).

3. Registration and User Account

Registration is required to use certain features. Registration is done via Apple Sign-In.

You are obligated to keep your login credentials confidential and protect them from third-party access.

Use of the app is permitted from the age of 13.

4. In-App Purchases and Subscriptions

The app offers a paid Creator subscription with extended features:

• Creator Subscription: Monthly, cancelable anytime
• Price: The current price is displayed in the App Store before purchase
• Payment Processing: Handled exclusively through Apple (App Store)

The subscription automatically renews for the respective term unless canceled at least 24 hours before the end of the current period.

Cancellation is done through your Apple Account settings. Refunds for already paid periods are excluded according to Apple's policies.

After canceling the subscription, you retain access to the basic features of the Community plan.

5. User Obligations

When using the app, you agree to:

• Not upload illegal, offensive, or objectionable content
• Not infringe on third-party copyrights
• Not provide false or misleading information
• Not misuse the app for commercial purposes
• Not perform automated access or scraping
• Not distribute malware

We reserve the right to remove content and suspend user accounts that violate these obligations.

6. Intellectual Property

All rights to the app, including design, code, trademarks, and logos, belong to Othmar Fetz or the respective rights holders.

Content you upload to the app (e.g., photos, descriptions) remains your property. However, by uploading, you grant us a simple, transferable license to use, display, and process this content within the app's functionality.

For publicly shared locations, you agree that they can be viewed by other users of the community.

7. Availability

We strive for high availability of the app and website. However, uninterrupted availability cannot be guaranteed.

Maintenance work, technical issues, or force majeure may lead to temporary restrictions.

8. Liability

We are fully liable for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or through gross negligence.

For damages caused by slight negligence, we are only liable for breach of essential contractual obligations and limited to foreseeable, contract-typical damages.

We assume no liability for:

• The accuracy, completeness, or timeliness of user content
• Damages caused by the use of third-party services
• Data loss that could have been avoided through reasonable data backup

9. Changes to Terms of Use

We reserve the right to change these Terms of Use at any time. We will inform you of significant changes via email or in-app notification.

Continued use of the app after changes take effect constitutes acceptance of the changes.

10. Termination

You can delete your user account at any time. Cancellation of a paid subscription is done through your Apple Account.

We reserve the right to terminate user accounts with immediate effect in case of serious violations of these Terms of Use.

11. Applicable Law and Jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers residing in the EU, the mandatory consumer protection provisions of their country of residence also apply.

The place of jurisdiction for disputes with businesses is Wels, Austria. For consumers, the statutory jurisdiction applies.

12. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
